Slander & Libel: What’s The Difference?

Slander and libel are two forms of defamation – the act of damaging someone’s reputation with false statements to a third party.

Slander is damaging statements made verbally. They are not broadcast or recorded. For example, someone who makes a false and negative statement about you in a restaurant is an example of slander.

Libel is written defamation published or broadcast, including newspapers, articles, the internet, and social media. For example, someone who posts a false and damaging comment on a website is an example of libel.

Both slander and libel carry legal consequences.

Do You Have a Slander or Libel Case?

Publication

It Was False

Spreading information without verifying its accuracy can be grounds for a defamation lawsuit, although there are some circumstances in which more than negligence must be shown.

A fact is a declaration of something true. If a statement is true, it is not defamation. For example, if someone posts a mugshot from your past legal issue, while unpleasant, it may not qualify as defamation if it is factually accurate.

Rumors can sometimes qualify as defamation, but the situation must meet legal standards.
